These Terms and Conditions set out the basis on which Waste Clearance Camberwell provides waste and rubbish collection, removal and related services. By making a booking, requesting a quotation, or allowing our operatives to carry out any work, you agree to be bound by these Terms and Conditions.

These terms apply to all domestic and commercial customers using our waste clearance, rubbish removal, bulky item collection and related services within our normal operating area. If you do not agree with any part of these terms, you must not proceed with a booking or allow the service to be carried out.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 "Company", "we", "us" and "our" mean Waste Clearance Camberwell, the service provider.

1.2 "Customer", "you" and "your" mean the person, company or organisation that requests or receives the services.

1.3 "Services" means waste clearance, rubbish removal, bulky waste collection, garden waste clearance, commercial waste collection and any related services provided by us.

1.4 "Waste" means items, materials and rubbish presented by you for collection and disposal, including household waste, commercial waste, garden waste and bulky items, but excluding prohibited or hazardous materials as set out in these terms.

1.5 "Booking" means a confirmed appointment for the provision of services, whether made by telephone, email, online form or in person.

2. Scope of Services

2.1 We provide waste collection and clearance services for domestic and commercial customers, including one-off clearances, regular collections and ad-hoc rubbish removal.

2.2 Our services typically include the loading of waste onto our vehicles, transportation of that waste, and disposal or recovery at an appropriately licensed facility in accordance with applicable waste regulations.

2.3 We reserve the right to refuse to collect or handle any items that we reasonably believe to be hazardous, illegal, unsafe to move, or not compliant with applicable waste regulations.

2.4 We do not provide cleaning, disinfection, pest control or building work as part of the standard waste clearance service, unless expressly agreed in writing.

3. Booking Process

3.1 Bookings can be made by contacting us by telephone or by completing an enquiry through our online or email channels. You will need to provide accurate information about the type and estimated volume or weight of waste, access to the property, and any relevant parking requirements.

3.2 Any quotation provided before our arrival is based on the information supplied by you. If, on arrival, the waste is substantially more than described, contains different materials, is harder to access, or otherwise differs from the information previously given, we may revise the quotation or decline to carry out all or part of the services.

3.3 A booking is not confirmed until we have accepted your request and provided you with a date and time window for the service. We may confirm bookings verbally or in writing.

3.4 Time slots are provided in good faith, but are approximate. While we use reasonable efforts to attend during the agreed time window, circumstances such as traffic, weather, prior jobs overrunning or operational issues may cause delays. We will endeavour to inform you if we expect to be significantly early or late.

3.5 Where access or parking restrictions apply, you must inform us at the time of booking. If we arrive and are unable to safely park or access the waste due to restrictions not previously disclosed, we may charge a call-out fee or, at our discretion, reschedule the booking.

4. Quotations and Pricing

4.1 Prices are typically based on the volume and type of waste, weight where applicable, labour involved, access conditions, and any additional services requested. We may provide estimated prices in advance and confirm the final price on site once we have inspected the waste.

4.2 Quotations are given exclusive of any applicable taxes unless stated otherwise. If tax rates change between the time of quotation and the time of service, the amount payable will be adjusted accordingly.

4.3 Any quotation given is valid only for the specific waste and circumstances described. If additional items are added for removal, or if the collection conditions change, we may adjust the price to reflect the additional work or costs.

4.4 Where a price is agreed on site, and you authorise us to proceed, that price will be binding for the work described and carried out during that visit.

5. Payments

5.1 Payment is due in full upon completion of the services, unless an alternative arrangement has been agreed in writing before the service takes place.

5.2 We accept common forms of payment such as cash, debit or credit card, and where agreed, bank transfer or invoice payment for business customers. We may require identification or additional details for certain payment methods.

5.3 For account or commercial customers, payment terms will be specified on the invoice or separate agreement. If no terms are specified, payment is due within 14 days from the invoice date.

5.4 If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate applicable in England and Wales, as well as reasonable administration and collection costs.

5.5 We may withhold or suspend services, or decline future bookings, if you have outstanding unpaid invoices or a history of late payment.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking by contacting us directly. We request as much notice as possible if you need to change or cancel an appointment.

6.2 If you cancel a booking more than 24 hours before the agreed time window, no cancellation fee will usually be charged.

6.3 If you cancel less than 24 hours before the agreed time window, or if our team attends the property and is unable to gain access or complete the work for reasons within your control, we may charge a cancellation or call-out fee to cover our costs.

6.4 We reserve the right to cancel or reschedule a booking due to operational reasons, staff illness, vehicle breakdown, adverse weather, safety concerns, or other circumstances beyond our reasonable control. Where possible, we will offer you an alternative time or date. We will not be liable for any loss or inconvenience caused by such cancellations, other than refunding any pre-paid amounts for services not provided.

7. Customer Responsibilities

7.1 You must ensure that our operatives have safe, reasonable and unobstructed access to the waste to be collected. This includes arranging any necessary permissions for parking or access through common areas, gates or shared entrances.

7.2 You are responsible for ensuring that the waste presented for collection is suitable for removal and does not contain prohibited or hazardous materials, unless we have expressly agreed to handle such materials in accordance with relevant regulations.

7.3 You must provide accurate information regarding the nature of the waste, including any sharp objects, heavy items, or materials that may require special handling.

7.4 If the collection requires entering your property or premises, you are responsible for securing valuables and breakable items. Our operatives will take reasonable care, but we cannot be responsible for pre-existing damage or for items left in unsafe positions.

8. Prohibited and Hazardous Waste

8.1 Certain items are considered hazardous or require specialist handling and may not be accepted as part of our standard waste clearance service. These may include, but are not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised containers, explosives, radioactive materials and certain electrical items.

8.2 If you have hazardous or specialist items that require removal, you must inform us in advance. We may, at our discretion, provide or arrange a suitable service or refer you to an appropriate specialist provider.

8.3 If hazardous or prohibited items are found mixed with general waste on arrival, we may refuse to collect the entire load, or remove only the non-hazardous portion. Additional charges may apply for sorting or handling contaminated loads.

8.4 If hazardous or prohibited waste is discovered after collection and has been incorrectly declared or concealed, you will be responsible for all additional costs, regulatory charges, fines or penalties that may arise as a result.

9. Waste Regulations and Duty of Care

9.1 We operate in accordance with applicable UK waste legislation and regulations. We will transport and dispose of collected waste using licensed facilities and authorised carriers, and we will take reasonable steps to ensure compliance with our legal duties.

9.2 You have a duty of care to ensure that your waste is transferred only to a properly registered waste carrier. By using our services, you recognise that we act as such a carrier and that we may provide appropriate documentation where required by law.

9.3 We may issue a waste transfer note or similar documentation for certain collections, particularly for commercial or regular business customers. You should retain any such documents for your own records and for regulatory compliance purposes.

9.4 We may separate and sort waste to maximise reuse, recycling or recovery, subject to local facilities and regulations. The method and location of disposal or recovery is at our discretion, provided it is legally compliant.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in the provision of our services. However, our liability to you in connection with the services, whether in contract, tort or otherwise, is subject to the limitations set out in this section.

10.2 We will not be liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity or loss of reputation, arising from or in connection with the services or any delay or failure to provide them.

10.3 Our total liability to you for any loss or damage arising from or in connection with one booking or series of related bookings shall be limited to the total amount paid or payable by you for the relevant services, unless otherwise required by law.

10.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

10.5 You are responsible for any damage or loss caused to our vehicles, equipment or staff as a result of your negligence, wilful misconduct or breach of these terms, including where unsafe conditions or undisclosed hazards are present at the collection site.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing full details of the issue.

11.2 We will investigate complaints in a fair and timely manner and may request additional information or evidence to help us understand and resolve the matter.

11.3 Where we determine that we have failed to provide services with reasonable care and skill, we may, at our discretion, offer a remedy such as a partial refund, price reduction, or re-performance of all or part of the service.

11.4 If a dispute cannot be resolved amicably, it may be referred to the courts of England and Wales as set out under governing law and jurisdiction below.

12. Privacy and Data Protection

12.1 We collect and use personal information necessary to manage bookings, provide services, process payments and communicate with you. We take reasonable steps to protect the security and confidentiality of such information.

12.2 We may retain records of your contact details, service history and invoices for legal, tax and operational purposes. We will not sell your personal data to third parties.

12.3 You may contact us to request access to the information we hold about you, or to ask for corrections where details are inaccurate.

13. Variations to Terms

13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, industry practice or our operational requirements.

13.2 The version of the terms in force at the time of your booking will apply to that booking. If we make significant changes, we may highlight them on our website or during the booking process.

14. Severability

14.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be deemed severed from the remaining terms, which will continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of services by Waste Clearance Camberwell.

By proceeding with a booking or allowing us to carry out any waste clearance or rubbish removal work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
